AMRN appeal hearing date set for Sept 2, 2020
Today, the Federal Circuit set a Sept. 2, 2020 (10:00 AM) hearing date/time for the AMRN Vascepa ANDA appeal. See the attached notice from the appellate court. As I reported to you, and as confirmed by AMRN today (see AMRN Faq link below), the panel of appellate judges that will hear the Vascepa ANDA appeal, will be named on the morning of the hearing. We plan to listen live to the hearing and will report to you, our view on whether the hearing changed AMRN's chances of success. As part of this, as I reported to you previously, importantly, we plan to report to you on whether the 3 judges on the panel appear to have a bias for or against pharmaceutical patent holders once we know the identity of the 3 judges.
In the meantime, we are looking at the pending AMRN patent applications and other AMRN issued patents outside of the ANDA litigation, to determine whether AMRN might have another angle to try to block generics, even if they lose the appeal and ANDA litigation. We plan to report to you on this before the Sept. 2 hearing.
