AMRN appeal hearing scheduled for tomorrow
It's a big day for the AMRN ANDA litigation appeal tomorrow. We plan to make several posts on our subscriber forum pages.
We eagerly await naming of the Federal Circuit panel tomorrow morning, before 10AM EST, which as we have indicated to you repeatedly, will be telling, even if it is a panel that we don't initially read as biased for non-obvious, or obvious. We will post the names of the panel and whether we have an initial view on bias before the oral hearing starts.
The AMRN hearing should go from about 10:30 AM EST to about 11 AM EST. We will post our initial view of how the hearing went shortly thereafter on the subscriber forum pages.
We will post again in the coming days after we have a chance to listen to the recording and consider the matter further and next steps.
We have analyzed some of AMRN's patents and AMRN's patent prosecution activity, that are not part of this litigation and plan to provide an update in the coming weeks.
